1. Who you are contracting with

You are entering into this agreement with Anna Telnykova, the provider and operator of Tasha Beauty. If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation. If you are using it as an individual, you confirm that you are of legal age to form a binding contract.

2. Acceptance of these Terms

By continuing to access or use the Service, you accept these Terms and agree to be bound by them, as well as any policies referenced here, including our Refund Policy and Privacy Notice.

3. Your subscription

Tasha Beauty is offered as a paid monthly subscription. Pricing, billing frequency, renewal, cancellation and refunds are handled by our reseller, Paddle. Please review the Paddle Buyer Terms at paddle.com/legal/checkout-buyer-terms for the payment, billing, tax and cancellation mechanics that apply to your purchase. Your subscription renews automatically until cancelled, and you may cancel at any time. We also offer a 30-day money-back guarantee, as described in our Refund Policy.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

• use the Service for any unlawful, fraudulent or harmful purpose;
• send spam, or harass, abuse or harm another person;
• infringe the intellectual property or privacy rights of others;
• upload images of other people without their consent, or content that is illegal, hateful, sexually explicit involving minors, or otherwise objectionable;
• interfere with or compromise the security or integrity of the Service, including via malware, probing, scraping or reverse engineering;
• resell, redistribute or circumvent technical limits of the Service.

5. AI features, try-on and your content

Tasha Beauty includes generative AI and image-editing features, such as virtual wig and hairstyle try-on and a personalised style and beauty advisor. When you use these features:

• You are responsible for the prompts and images you provide, for how you use any outputs, and for confirming you have the rights to any content you upload.
• You retain ownership of the photos and content you upload. You grant us a limited licence to process them solely to provide the AI features to you.
• You must not use the AI features to create deepfakes, impersonate others, generate illegal or deceptive content, or attempt to jailbreak or misuse the models.
• AI outputs may be inaccurate or imperfect and are provided for personal, informational purposes only. They are not professional medical, nutritional, financial or legal advice, and should not be relied upon as such without independent verification.
• We may moderate, filter, restrict or remove content and outputs, and may refuse or limit AI generation, to keep the Service safe and lawful.

If you believe content on the Service infringes your rights, contact us so we can review and, where appropriate, remove it. We may suspend or terminate accounts of repeat infringers.

6. Intellectual property

The Service, including its software, design, branding, text and other materials (excluding content you upload), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within your chosen plan. You may not copy, modify, distribute, sell or lease any part of the Service.

7. Reseller and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

8. Service availability and warranties

We work hard to keep Tasha Beauty available, but we do not guarantee that the Service will be uninterrupted, error-free or secure. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay, create a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service and cancel your subscription at any time.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages, or loss of profits, data or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
